Deadline for Applicant to respond to City of Yarra's advice to Applicant (Banco) of Council resolution at 16 November 2004 meeting, stating 'that Council request the applicant to substitute the current permit application plans PL03/4307, with the "without prejudice plans" within 2 weeks so that Council can take the plans out for comprehensive community consultation'. Council receives correspondence (dated 30 November 2004) from Fulcrum Town Planners for the Applicant advising that 'we anticipate it will take a further month to finalise the plans, at which time it is anticipated that we will formally lodge them with Council'.

CAG representatives meet with Yarra Councillors for Langridge Ward Jenny Farrar and Steve Jolly to discuss a community position on the Applicant's approach to Yarra Council requesting an additional month to finalise and lodge new development plans for Smith Street. CAG agrees to support the Ward Councillors in granting an extension subject to conditions including requesting the Applicant to consider documentation (CAG Interim Submission, the report Inner Urban Conservation and Redevelopment, issues raised by the 1500 objectors) in revising their plans, Council officers assessing revised plans with reference to this documentation, and Council developing a community consultation plan in conjunction with CAG, including convening a public meeting.

Collingwood Action Group hosts end of year do at the Grace Darling Hotel and invites residents, businesses, local councillors and lovers of Smith Street.

CAG representatives attend first meeting of newly elected Yarra Council. For Agenda Item 'Status report for Planning Permit Application PL 03/1407 the following motion carried (moved Cllr Farrar, seconded Cllr Jolly), precised here: Council accept the Applicant's request for an extension of time to substitute the current application with amended plans based on the 'without prejudice plans' be extended to 31 January 2005 so that Council can take the plans out to community consultation; if the Applicant does not substitute plans within this timeframe, Council officers prepare a thorough assessment of the Application ... if the matter is recommended for refusal, it will be dealt with under delegation, if not, it is to be presented to Council's Internal Development Approvals Committee for determination; if Council has determined the Application and the Applicant goes to VCAT or the Applicant for Council's failure to determine Council will request the Minister to call in the Application; in approving the Applicant's request for an extension of time, the Applicant be requested to take into consideration CAG's Interim Submission, the independent panel report Inner Urban Conservation and Redevelopment, and concerns raised through community consultation (ie the 1500 objectors); when assessing the plans the Council officer's report assess the proposal against relevant provisions of the Planning and Environment Act 1987, the Yarra Planning Scheme, relevant Council policies, comments of referral authorities including internal advice, all submissions received and any other relevant matter including the above documents; upon submission of the substituted plans, a community meeting be convened mid to late February 2005, to ensure maximum awareness and public participation prior to Council assessment and determination of the application; and a community consultation plan be developed.
