Banco given extension by Yarra to lodge new Smith Street development plans
The first meeting of the newly elected Yarra Council on 14 December 2004 resolved to grant developers Banco an extension until 21 January 2005 to lodge revised plans for Smith Street.
The resolution - moved by Councillor Farrar and seconded by Councillor Jolly - also committed Council to asking the developer to consider key documentation in submitting revised plans (the independent panel report 'Inner Urban Conservation and Redevelopment', CAG's 'Interim Submission', and concerns raised by 1500 objectors), and the development of a comprehensive community consultation process to consider any new plans submitted including a mass public meeting in February 2005.

1. Council accept the Applicant's request dated 30 November 2004 for an extension of time to substitute the current application plans PL03/1407 with amended plans based on the 'without prejudice plans' and that the revised deadline be extended to 31 January 2005 so that Council can take the plans out to community consultation.
2. If the Applicant does not substitute plans within this timeframe, Council officers will prepare a thorough assessment of the Application. If the matter is recommended for refusal, it will be dealt with under delegation. If not, it is to be presented to Council's Internal Development Approvals Committee for determination.
3. If (a) Council has determined the Application and the Applicant lodges an Application for review to the VCAT pursuant to Section 77 of the Planning and Environment Act 1987; or (b) the Applicant applies to VCAT for review of the failure of Council to grant a permit within the required time pursuant to section 79 of the Planning and Environment Act 1987, Council will request the Minister to exercise her power pursuant to Clause 58 of Schedule 1 of the VCAT Act 1988 to call in the Application.
4. In approving the Applicant's request for an extension of time, the Applicant be requested to take into consideration the following (a) CAG's Interim Submission, June 2004 (b)'Inner Urban Conservation and Redevelopment: An independent panel report on a proposal for Smith Street Collingwood under Melbourne 2030', this includes the equitable design envelope by Steve Fargo, and (c) the concerns raised through community consultation.
5. When assessing the permit application, the Council's officer report will provide a thorough assessment of the proposal against relevant provisions of the Planning and Environment Act 1987, the Yarra Planning Scheme (and to the extent that they are relevant to the permission sought), relevant Council policies, comments of referral authorities including internal advice, all submissions received and any other relevant matter including the above documents.
6. That upon submission of the substituted plans, a community meeting be convened mid to late February 2005, to ensure maximum awareness and public participation prior to Council assessment and determination of the application.
7. That a community consultation plan be developed.
